This agreement represents the complete agreement and understanding between DesignedbyLara.com (hereinafter called DBL) and the customer (hereinafter called Client or User) and supercedes any other written or oral agreement. DBL reserves the right, in its sole discretion, with or without notice, may modify, these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change the services offered. Client or User must comply with DBL's current "Policies," as updated from time to time by DBL, which can be viewed at DBL web site.
We reserve the right to add to or take away from these policies at any time for any reason. It is the client/users responsibility to remain informed. By accessing this website you agree to ALL of our policies. When you purchase anything it is the same as a written contract. Client/User AGREES to abide by ALL of our present and future policies.

All content and graphics are protected by copyright laws. All content and graphics on this site are the sole property of DesignedByLara.com and Alibelle Web Solutions. We will seek prosecution for any violation of copyright laws, altered or copied images, content, etc that is taken from this site without purchase or written permission.
Altering Design Work - CLIENT/USER may NOT alter, resize, or change ANY of the graphic/design work (including but not limited to; headers, buttons, logos, e-book covers, etc.) of Designed by Lara without WRITTEN permission from Lara Velez, owner of DesignedbyLara.com. We do not want our images altered for many reasons, the most important being that our name is on it and we want it to remain in the quality that WE designed it. Our reputation and excellence is VERY important.
CLIENT/USER may not use any of the images in the work we provide for any other purposes than what they were created for (including but not limited to; print design, other websites, creating banners and buttons, etc.) WRITTEN permission from Lara Velez, owner of DesignedbyLara.com.
Also, these things may infringe on the designer of any images used within a design.
If CLIENT/USER would like a resize, banner or button, or any alteration or addition to a design, simply let us know. We offer these services for a nominal fee. :)
Logo Design - If DesignedbyLara.com creates a logo design for CLIENT/USER and CLIENT/USER uses this design including but not limited to; in print, on any packaging, offline or online, a credit must be included in a viewable place somewhere on the item or place that the logo resides. (ie. logo designed by: http://www.designedbylara.com) NOTE: It is REQUIRED that CLIENT/USER contact Lara Velez, owner of DesignedbyLara.com and let her know exactly where the logo will be and how you will credit her designs.

Failure to comply with ALL copyright terms listed above and below is a direct violation of copyright laws. Please read Section 504(c)(2)(http://www.copyright.gov/title17/92chap5.html#504).
Payment
IMPORTANT!!! You do NOT OWN ANY OF OUR DESIGNS! They are on loan to you as long as you follow our policies. Also...You may NOT sell them or give them away. They are for purchaser's use ONLY. Period!
All payments are due before work DBL begin. We will accept Pay Pal, Personal Checks, and US Postal Money Orders. All payments must be CLEARED before work will begin.
Refunds
NO refunds are provided once design process has begun. Period.
If the design process has not begun (meaning we have done NO work and spent NO time on your project) and a refund is plausible, you will receive your refund via snail mail OR Pay Pal refund...OUR choice. The refund, IF plausible will be issued within 90 days. It is DesignedbyLara.com's discretion WHEN and IF refunds are issued. Period.
Blog/Website Location and Display Policies
IMPORTANT!!! You do NOT OWN ANY OF OUR DESIGNS! They are on loan to you as long as you follow our policies. Also...You may NOT sell them or give them away. They are for purchaser's use ONLY. Period!
Since Designed by Lara does not design for just anyone and we reserve the right to refuse services based on what we believe to be the type of sites we want to be associated with, we REQUIRE to know WHERE our designs will be. If you change the location, you MUST let us know within 30 days or you will be in breach of contract!
Also, you may NOT give away, redistribute, or sell our designs to ANYONE without WRITTEN permission.
Furthermore, If you do not use a design we created, and/or you have removed a design from the location you said it would be, and/or have not let us know the new location for a period 90 days, we reserve the right to RESELL the design.
We WILL seek legal justice if these matters are not taken seriously.
Revisions
While we want to make our customers happy, we can not be held liable for any service that we provide for any reason. We will take the time to discuss your wishes and get it right the first time.
Designed By Lara will do up to ONE revision for each image purchased. And, up to ONE revision for custom image, template, or web design. Additional revisions are $5 each and up depending on what it entails.
Custom Blogs and Web Templates come with up to TWO revisions. Additional revisions cost more. We will inform you ahead of time what the cost would be. (It is usually between $10-$50 depending on what is required.)
Additionally, if we feel that we have done all that we can to make you, the client happy and there seems no reasonable way to provide you with what you desire, we reserve the right to stop the process. Period. No refunds will be given. The reason no refunds will be given is because we base our fees on the amount of time we expect a certain project to take. If we are refusing to continue working with you, you can be ASSURED that we have already exceeded the time you paid for and have EARNED what was paid.
Keep in mind, we work VERY hard to make our clients happy. You are free to read our many testimonials, and visit the sites of our past clients, and even contact them and personally ask them what they think.

Custom banner or buttons purchases do not require a link back. However, if you place a link back to designedbylara.com on your home page you will be eligible for 10% off any future purchases. And, we will appreciate it! ;)

ALL Premade and Custom Wordpress themes, Blogger Templates, Logos, and Newsletter Templates REQUIRE a link back. It is a form of advertising that helps keep our prices low.
ALL Sale Priced Premade buttons, banners, headers, and Wordpress themes REQUIRE a link back.
For templates and website design a link back on at least the home page is REQUIRED.
Freebies
IMPORTANT!!! You do NOT OWN ANY OF OUR DESIGNS! They are on loan to you as long as you follow our policies.
ALL FREEBIES REQUIRE a link back to our site. Exception - We would APPRECIATE a link back for free banners, and button images if possible, we do not require a link back for these, however, the web address ON the image is NOT to be altered in ANY way. Period. If we find one of our Free images without the web address, we will pursue prosecution for violation of copyright laws and breach of contract.
Wordpress Themes, Blogger Templates, and Newsletter Templates ALL REQUIRE and ACTIVE, VIEWABLE, and FOLLOWABLE link to be IN TACT at the bottom of all pages. Example: Designed by Lara
Logos and Headers require a link or button places on the sites HOME page. The link is required to be ACTIVE, VIEWABLE, and FOLLOWABLE link to be IN TACT
Images
We use royalty free images for most of our work. You agree to keep a link on your site giving credit to where the image came from. Failure to do so could cause you major legal trouble from the image owner. You should also know that these images may be elsewhere on the web. We will not create themes with the same images. However, the images are available for others to use. If you wish to have an image that is exclusive, let us know and we will tell you what the additional cost would be.
DBL will NOT be held liable under ANY circumstances for any Image copyright law violations. Period.
It is the CLIENT/USERS responsibility to be informed.
More On Images...
DBL charges additional fees for the searching of images for design projects, unless stated otherwise. However, even if we agree to search for images, we have limitations. Once we reach a point where we feel we can not find an image that makes the CLIENT/USER happy, the CLIENT/USER will need to look for themselves or possibly pay additional fees. DBL reserves the right to decide this on a case by case basis.
LIMITED LIABILITY
a. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT AND UNDER NO LEGAL THEORY SHALL DBL BE LIABLE TO THE ACCOUNT HOLDER FOR ANY BUSINESS LOSS, REVENUES DECREASE, EXPENSES INCREASE, COSTS OF SUBSTITUTE PRODUCTS/SERVICES, OR FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE USE OF, OR INABILITY TO USE, ANY OF DBL SERVICES, EVEN IF DBL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL DBL LIABILITY EXCEED FIVE DOLLARS. THIS LIMITATION OF LIABILITY AND RISKS IS REFLECTED IN THE PRICE OF DBL SERVICES.
b. The CLIENT/USER acknowledges that DBL makes an honest effort to keep the information available on DBL's systems accurate. However, DBL can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity for the data and/or information available. Use of information obtained from or through DBL is at the risk of the CLIENT/USER.
c. The CLIENT/USER acknowledges that the information available through the interconnecting networks may not be accurate. DBL has no ability or authority over the material. DBL can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity of the data and/or information residing on or passing through these networks. Use of information obtained from or through DBL services is at the risk of the CLIENT/USER.
d. The CLIENT/USER understands, agrees and acknowledges that DBL makes an honest effort to provide the CLIENT/USER with Technologies, Developments and Innovations that part of them are being licensed, or co-branded, from or by, third-party entities. However, DBL can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, reliability or validity for the application(s), data and/or information involved in such items. DBL specifically disclaims all warranties of merchantability and and fitness for a particular purpose. The use of these application(s), data and/or information obtained from or through DBL, or any other referred third-party, directly or indirectly, is at the risk of the CLIENT/USER.
e. The CLIENT/USER understands, agrees and acknowledges that DBL will use its best efforts to maintain a full time Internet presence for CLIENT/USER. The network may be down due, but not limited to, utility interruption, equipment failure, natural disaster, acts of God, or human error. CLIENT/USER agrees that these events may or may not occur and CLIENT/USER will hold DBL, its Parents, Subsidiaries, Affiliates, Executives, Directors, Officers, Managers, Employees, Successors, Assigns, Consultants and Agents, free and harmless from any damages incurred in any event of any type of loss resulting from any reason whatsoever. Uses of DBL service is at the risk of the CLIENT/USER.
Use of Material
a. Public Domain materials (e.g., images, text, and programs) may be downloaded or uploaded using DBL services. CLIENT/USER may also re-distribute materials in the public domain. The CLIENT/USER assumes all risks regarding the determination of whether the material is in the public domain.
b. As provided by United States federal law, Canada federal law and by International law, copyrighted materials (e.g., images, text, and programs) may not be uploaded using DBL services without the permission of the copyright holder. Copyrighted materials may be downloaded for personal use. Except as expressly permitted, materials under copyright may not be distributed to others. Copyrighted material may not be changed nor can the author attribution notices nor the copyright notices be modified.

We reserve the right to refuse anyone for any reason. Period. Designed by Lara will NOT create anything for porn, hate, witchcraft, or any type of site that WE feel is not what we want to be associated with.
We cannot be held liable for any client that does not read these policies. Usage of this site AUTOMATICALLY puts the client IN AGREEMENT with all policies now and in the future. Period.
